This is a first victory for the defense in the trial of the former prosecutor of Dixinn, Algassimou Diallo.
Although his lawyer had requested that the case be adjourned until Friday's hearing, the various parties met again on Tuesday before the competent jurisdiction to debate a crucial question: should the trial be adjourned or continue immediately?
At the end of this hearing devoted to the issue of referral, the court finally decided to postpone the examination of the case until October 15.
No judgment without the accused
In criminal matters, except in cases of flight, a person being prosecuted must appear at the hearings concerning them. Based on this principle, the defense argued that the Court could not rule in the absence of Algassimou Diallo.
"Unless she (the accused person) is on the run, the person concerned must be present at all hearings concerning her. Mr. Algassimou was not there this morning, contrary to this principle," said Moussa Diallo, one of the defense lawyers.
The Supreme Court has therefore set the next hearing for October 15, 2026, giving the defense time to prepare its arguments and the public prosecutor's office time to make arrangements to bring Algassimou Diallo to trial.
As a reminder, Algassimou Diallo has been held in pretrial detention since August 27, 2026, at the Macenta prison, more than 700 kilometers from the capital. He is being prosecuted for "incitement to discrimination, hatred or violence through discrimination, and criminal conspiracy."
